EPA Publishes New Regulations for Pharmaceuticals in Healthcare Facilities

URBANDALE, IA – 02-22-2019 (PRDistribution.com) — The Environmental Protection Agency (EPA) published a final rule in the Federal Register titled Management Standards for Hazardous Waste Pharmaceuticals and Amendment to the P075 Listing for Nicotine (CFR Part 266 Subpart P)

These new regulations, which are commonly referred to as Subpart P, encompass sweeping changes across the entire healthcare industry for how hazardous waste pharmaceuticals are managed, transported and disposed of by healthcare facilities and reverse distributors.In addition to EPA’s Subpart P, the nicotine amendment no longer considers FDA approved over-the-counter nicotine gum, patches and lozenges to be hazardous.  Previously, those were deemed as acutely hazardous by the EPA.  This exemption, however, does not apply to nicotine liquids and e-cigarettes.    Part of the new regulations call for a sewer ban of all hazardous waste pharmaceuticals by healthcare facilities that goes into effect nationally in August of this year.  Healthcare facilities will no longer be able to dispose of pharmaceuticals that are considered to be hazardous waste by the EPA.”These new regulations will affect everywhere pharmaceuticals, including over-the-counter drugs are sold or administered.  It’s amazing how many of our country’s facilities will be impacted by these significant regulations.  Even facilities that you would normally not consider healthcare providers are impacted.” said Jeff Hollar, President of PharmWaste Technologies.  In fact, we have devoted a large portion of our website in educating the public on the various aspects of the new regulations, the facilities impacted, including when each state anticipates adopting the new regulations.  Says Hollar.
EPA indicates the following facilities will potentially be impacted: retail pharmacies, hospital inpatient pharmacies, outpatient care centers, wholesaler distributors, supermarkets, warehouse clubs, psychiatric hospitals, ambulatory services, surgical centers, health clinics, optical providers, dental providers, chiropractors, physicians’ offices, mail?order pharmacies, nursing care facilities, skilled nursing facilities, hospice facilities, long term care pharmacies, veterinary clinics, veterinary hospitals, veterinary pharmacies, 3rd party logistics providers, and?locations that sell pharmaceuticals over the internet, mail or other distribution systems.  And this list is not all-inclusive!  Subpart P and the nicotine amendment goes into effect in some states like Iowa and Alaska this year.  Some states will need to adopt these new regulations through their state legislative process.  Depending on the state, this could be relatively soon or one to two years down the road.There are many facets to the new regulations.  To download a copy of the final rule and learn more about Subpart P and when it is going into effect in your state, go to PharmWaste Technologies website at  www.pwaste.com and select the EPA Subpart P tab.
