Special Needs Teacher Files Local, State and Federal Complaints Against Wyndham Vacations Inc., for Deceptive & Predatory Business Practices & Fraud

United States, Florida, Venice – 10-07-2019 (PRDistribution.com) — Timeshare Cancellation Attorney Susan Budowski has filed 7 regulatory complaints on behalf of her client. Under sworn affidavit her client attests to Wyndham’s sales agents continually targeting her while still grieving the passing of her husband. Her original purchase was for 84,000 points in 2015. Within 36 months she was coerced into signing 4 upgrades bringing her to 846,000 points. Attorney Budowski’s client is a 61-year-old widow who has been a special needs teacher for over twenty years. She spent the last 15 years caring for her paraplegic husband before his passing. She thought the initial purchase would be good for her after what she had been through, little did she know instead of being able to rest and relax after the loss of her husband, she would be pressured and preyed on for the next 3 years.

Attorney Budowski’s client goes on to describe the extreme pressure, highly stressful and predatory nature in which the Wyndham agents repeatedly targeted her despite her multiple pleas she could not afford additional points. The intimidation and fearmongering would continue to escalate until such time she signed another upgrade. On her last upgrade, she further attests to numerous tactics and misrepresentations that made her feel she had no choice but to sign again for something she expressed on multiple occasions she did not want nor could afford on her teacher’s salary. 

Several of the tactics included:

  • While at Bonnet Creek meeting her salesperson and two of his sales associates, she was told that her account had been “on hold” and of course this caused her great concern.  When she inquired as to why, she was told because she declined a previous “Black Friday” telephone deal;
  • They carried on the façade claiming they were working on getting the hold taken off her account so she could have the previous telephone offer reinstated and receive the “special price”.  She told them she declined the telephone upgrade deal;
  • She repeatedly conveyed she was a widow, on a school teacher’s salary and could not afford to purchase more points. At this stage, the two additional sales representatives began a hushed conversation regarding her utilizing her points for rental income.
  • The two representatives along with her salesperson told her the following:
  • That they would assist her in renting out her timeshare;
  • That the income derived from the rental would cover all of her costs and make this new purchase affordable;
  • That they could get into trouble for discussing the use of her timeshare as a rental property, but they were making a special exception for her;
  • That her previous upgrade that was a deeded week at Wyndham’s National Harbor Resort was not beneficial for her, and she’d be better off with all of her points in Club Wyndham Access;
  • And finally, that by doing so, she would be set for life: she would never have to sit through another presentation, and she would never need to upgrade again. 

Her client began calling for help to rent her points and no matter whom she spoke with at Wyndham she received the same answer, that Wyndham does not assist owners in renting out their points. The only option she was given to reduce her expenses was to convert her ownership points to help cover a portion of her maintenance fees. She had already done this in the past and the value was nominal as she was only able to cover one month of her maintenance fees. She detrimentally relied on the promise of rental income to be able to pay for the costs associated with her upgrade by the three sales agents at Bonnet Creek.

Her client has suffered a colossal financial hardship and emotional distress just trying to take her first vacation after the passing of her husband. She is so distraught over the continual abuse she endured, she wants her contracts canceled and monies refunded as there is no way she can trust Wyndham or any of its representatives in the future. The name Wyndham creates an emotional trigger. At this time she cannot afford to retire due the amount of debt she now owes Wyndham after being subjected to these predatory practices.

Attorney Budowski believes, “This type of predatory behavior attested to in her client’s sworn affidavit, is reprehensible for an organization supposedly selling happy vacations; her client is far from happy from the multiple traumas suffered at the hands of these commissioned Wyndham sales agents.”
